OPŠTI USLOVI
Pristupanjem i poručivanjem proizvoda preko Kišna glista, potvrđujete da se slažete sa Uslovima korišćenja i da ste obavezni da ih poštujete. Ovi uslovi važe za ceo sajt i svaku e-poštu ili drugu vrstu komunikacije između vas i Kišna glista. Ni u kom slučaju tim Kišna glista ne snosi odgovornost za bilo kakvu direktnu, indirektnu, posebnu, slučajnu ili posledičnu štetu, uključujući, ali ne ograničavajući se na gubitak podataka ili profita, nastalu korišćenjem ili nemogućnošću korišćenja materijala na ovom sajtu, čak i ako je tim Kišna glista ili ovlašćeni predstavnik bio upozoren na mogućnost takvih šteta. Ako korišćenje materijala sa ovog sajta dovede do potrebe za servisiranjem, popravkom ili ispravkom opreme ili podataka, snosite sve troškove. Kišna glista nije odgovorna za bilo kakve posledice koje mogu nastati tokom korišćenja naših resursa. Zadržavamo pravo da u bilo kom trenutku menjamo cene ili asortiman proizvoda i ažuriramo pravila korišćenja resursa.
Slažete se i potvrđujete da Kišna glista može privremeno ili trajno prekinuti pružanje Usluge (ili bilo koje funkcionalnosti unutar Usluge) po sopstvenom nahođenju, bez prethodne najave. Takođe, možete prestati sa korišćenjem Usluge u bilo kom trenutku. Nije potrebno posebno obaveštavati Kišna glista kada prestanete da koristite Uslugu. Ako Kišna glista onemogući pristup vašem nalogu, možete biti sprečeni u pristupu Uslugi, podacima sa naloga ili bilo kojim fajlovima i materijalima sadržanim u vašem nalogu. Ako odlučimo da promenimo Uslove korišćenja, te promene će biti objavljene na ovoj stranici i/ili će biti ažuriran datum izmene Uslova korišćenja. Kišna glista zadržava pravo da menja, suspenduje ili trajno ili privremeno obustavi sajt ili bilo koju povezanu uslugu, sa ili bez prethodne najave, bez ikakve odgovornosti prema vama.
KORIŠĆENJE SAJTA
Kišna glista obrađuje podatke (uključujući vaše lične podatke) koje nam pružite u skladu sa Uslovima korišćenja, Obaveštenjem o obradi ličnih podataka i Politikom kolačića. Korišćenjem sajta Kišna glista, slažete se sa obradom vaših ličnih podataka u skladu sa navedenim dokumentima.
Korišćenjem sajta i poručivanjem proizvoda preko sajta, slažete se da:

Ako ne pružite sve potrebne informacije, nećete moći da kupite proizvod. Poručivanjem proizvoda potvrđujete da imate preko 18 godina i sposobni ste da sklapate obavezujuće ugovore.
PORUČIVANJE PROIZVODA
Birajući i selektujući proizvode dostupne na sajtu Kišna glista, možete dodati željene artikle u korpu. Lista proizvoda u korpi može se menjati, a kroz korake kupovine završavate porudžbinu. Sva pružena informacija mora biti tačna. Završni korak je odabir načina plaćanja koji vam najviše odgovara; sve opcije plaćanja opisane su u sekciji „Načini plaćanja“.
Nakon poručivanja, dobićete e-mail obaveštenje sa svim informacijama o porudžbini. Ako iz nekog razloga isporuka nije moguća, Kišna glista je u obavezi da vas bez odlaganja obavesti.
KONVERZIJA VALUTE
Sve uplate se vrše u srpskim dinarima (RSD). Iznos koji će biti naplaćen na vašoj kreditnoj kartici dobija se konverzijom cene izražene u evrima u dinare po važećem kursu Narodne banke Srbije. Pri naplati na kartici, isti iznos se konvertuje u vašu lokalnu valutu prema kursu kartičnih udruženja, što može rezultirati manjom razlikom u odnosu na cenu prikazanu na sajtu.
NAČINI PLAĆANJA
Kišna glista prihvata plaćanje preko Visa, MasterCard, Maestro i American Express kartica. Ako izaberete plaćanje karticom koja može biti korišćena za elektronsku naplatu, bićete preusmereni na sajt Banca Intesa, gde unosite podatke o kartici i vršite uplatu. Ako je transakcija uspešna, bićete vraćeni na sajt sa obaveštenjem o uspešnoj uplati. Ako uplata nije uspešna, bićete vraćeni na sajt sa informacijom o neuspehu i moći ćete ponoviti uplatu ili izabrati drugi način plaćanja. Iz sigurnosnih razloga, podaci o kartici su vidljivi samo banci. Sajt banke je zaštićen i siguran.
Kišna glista nije u sistemu PDV-a.
Za sve porudžbine unutar Srbije možete odabrati plaćanje pouzećem preko Pošte Srbije, koje se vrši prilikom dostave. Plaćanje je moguće isključivo u gotovini dostavljaču.
Politika povraćaja i refundacije
U slučaju povraćaja robe i refundacije kupcu koji je prethodno platio jednom od platnih kartica, delimično ili u potpunosti, bez obzira na razlog povraćaja, Kišna glista je u obavezi da povraćaj izvrši isključivo putem VISA, EC/MC, Maestro, Amex i Dina platnih metoda, što znači da će, na zahtev prodavca, banka refundirati sredstva na račun vlasnika kartice.
Pravo na odustanak (14 dana)
U skladu sa Zakonom o zaštiti potrošača Republike Srbije, imate pravo da odustanete od kupovine i vratite robu u roku od 14 dana od dana prijema robe, bez navođenja razloga.
Da biste ostvarili ovo pravo, morate nas jasno i nedvosmisleno obavestiti pismenim putem (e-mailom ili poštom) pre isteka 14-dnevnog roka.
Ako odustanete od ovog ugovora, refundiraćemo vam sve uplate primljene od vas, uključujući troškove dostave (osim dodatnih troškova nastalih zbog izbora vrste dostave koja nije najjeftinija standardna dostava koju nudimo), bez odlaganja, i u svakom slučaju najkasnije 14 dana od dana kada smo obavešteni o vašoj odluci da odustanete.
Refundacija će biti izvršena istom metodom plaćanja koju ste koristili pri kupovini, osim ako ste se izričito dogovorili drugačije. Za takvu refundaciju se ne naplaćuju nikakve naknade.
Roba mora biti vraćena neupotrebljena, neoštećena i u originalnom pakovanju. Direktne troškove vraćanja robe snosite vi.
KAKO VRATITI ILI ZAMENITI ROBU

Imate pravo da vratite ili zamenite bilo koji ili sve proizvode Kišna glista kupljene direktno na našem sajtu u roku od 7 dana od prijema proizvoda.

Sva roba biće pregledana prilikom povraćaja.

Proizvod mora biti neupotrebljen – u originalnom pakovanju sa netaknutim etiketama i zaštitnim nalepnicama – i u istom stanju kao kada ste ga primili.

Ako proizvod nije dostupan u veličini ili boji koju ste odabrali, biće izvršena refundacija.

Ako želite drugi proizvod, ili proizvod koji želite ima drugačiju cenu od originalnog, potrebno je da vratite neželjeni proizvod radi refundacije i naručite novi.

Roba je vaša odgovornost dok ne stigne u naš magacin, zato je pažljivo zapakujte da ne bi došlo do oštećenja.

Kišna glista ne snosi odgovornost za robu izgubljenu tokom povratne pošiljke.

U zavisnosti od opcija u vašoj zemlji, snosite sve troškove vraćanja robe.

Koristite poštansku službu koja osigurava vrednost proizvoda koje vraćate i obavezno sačuvajte dokaz o slanju.

Nismo odgovorni za proizvode vraćene greškom.

Ako proizvod stigne u neadekvatnom stanju, možemo ga vratiti vama.

Delimična refundacija: u slučaju zahteva za refundaciju, troškove slanja i uvoznih taksi snosi kupac. Trošak povratne pošiljke je 35 EUR, plus uvozne takse. Ovaj iznos će biti odbijen od ukupnog iznosa refundacije.

Sve refundacije biće izvršene u istoj valuti u kojoj je izvršena kupovina.

Razlike u refundiranom iznosu nastaju zbog promena kursa i neće biti nadoknađene.

Troškovi slanja i uvozne takse nisu refundabilni.

Potvrdićemo prijem vaše žalbe u roku od 8 dana i dostaviti vam pisani odgovor da li je žalba prihvaćena, kao i metod i rok za rešavanje.
Ako je žalba prihvaćena, rešavanje može uključivati:

punu refundaciju
Rok za rešavanje žalbi neće prelaziti 15 dana od dana podnošenja žalbe.
OŠTEĆENI ILI NEISPRAVNI PROIZVODI
Oštećenja ili pogrešni proizvodi moraju se prijaviti u roku od 24 sata od isporuke. Ako je proizvod oštećen u transportu, morate nas obavestiti što je pre moguće sa detaljnim opisom i fotografijama.
Vrlo je važno da proizvod u svim tipovima povraćaja bude zapakovan tako da ne može biti oštećen tokom transporta. Ako vraćeni proizvod nema greške ili kvarove, naplaćuje se naknada za povrat od 35 EUR. Kišna glista zadržava pravo da defektne proizvode zameni proizvodima istog ili sličnog modela.
PONOVLJENI POVRATI
Nudimo fleksibilnu politiku povraćaja kako bismo olakšali vašu kupovinu. Imajte na umu da isti proizvod možemo zameniti za drugu veličinu samo jednom. Pratimo broj povraćaja kupaca, i kontinuirani povraćaji mogu biti označeni, odbijeni ili dovesti do zatvaranja vašeg Kišna glista naloga.
OTKAZIVANJE PORUDŽBINE
Napominjemo da možete otkazati porudžbinu u roku od 24 sata od kupovine. Razumemo da je to neobično, ali imamo ograničenu proizvodnju i veoma visok zahtev. Nakon isteka 24 sata, završavamo vašu porudžbinu i šaljemo je na vašu adresu.

By using Kišna glista website and ordering products through the website, you agree that:

By ordering products through Kišna glista website, you agree to Kišna glista using your data, as well as contacting you for the purpose of fulfilling your order, if necessary, and in accordance with the Notice on the Processing of Personal Data. If you do not provide all the information we need, you will not be able to purchase the product. When ordering products through the Website, you confirm that you are over 18 years of age and capable of entering into binding contracts.
Placing orders
By choosing and selecting among available Kišna glista products you can add your desired items in your cart. Product list in cart can be edited, and by clicking through steps of shopping procedure you are completing your order with Kišna glista. Be aware that all information that you are providing must be correct. Final step is choosing payment method that suits you the best and all payment possibilities are covered in the “Payment Methods” section.
After placing the order, you will receive an email notification containing all the information about the order. However, if for some reason the delivery of the ordered goods is not possible, Kišna glista is obliged to inform you without delay.
CURRENCY CONVERSION
All payments will be effected in Serbian currency – dinar (RSD). The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Serbian dinar according to the current exchange rate of the Serbian National Bank.
When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
PAYMENT METHODS
Kišna glista accepts payments via Visa, Master Card, Maestro and American Express. If you choose a payment via credit card that, based on the approval of the issuing bank, can be used for electronic payment, you can choose this payment method. After confirming the order, you will be redirected to the website of Banca Intesa, where you enter your payment card data and make the payment. If the transaction is successful, you will be returned to the Website with a notification that the payment has been successfully completed. In case the payment is unsuccessful, you will be returned to the Website with information about the payment failure and you will be able to repeat the payment or choose another payment method. For security reasons, your payment card data is visible only to Banca Intesa as a card processor. The bank’s website is protected and secure for this payment method.
Kišna glista is not in the PDV or VAT system.
For all domestic orders within Serbia borders you can choose payment as cash on delivery via Pošta Srbije which will be processed at your doorstep when package is delivered. Payment can only be made in cash to the delivery person who brought your order to you..
Return & Refund Policy
In case of return of goods and refund to a customer who has previously paid with one of the payment cards, partially or in full, regardless of the reason for the return, Kišna glista is obliged to make the return exclusively via VISA, EC/MC, Maestro, Amex and Dina payment methods, which means that, upon the request from the seller, the bank will refund the funds to the account of the cardholder.
Right of Withdrawal (14 Days)
In accordance with the Consumer Protection Law of the Republic of Serbia, you have the right to withdraw from your purchase and return the goods within 14 days from the day of receiving the goods, without giving any reason.
To exercise this right, you must notify us clearly and unambiguously in writing (via email or postal mail) before the expiration of the 14-day period.
If you withdraw from this agreement, we will reimburse you all payments received from you, including the costs of delivery (except for the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
The reimbursement will be made using the same payment method as you used for the initial transaction, unless you have expressly agreed otherwise. No fees will be charged for such reimbursement.
The goods must be returned unused, undamaged, and in their original packaging. You bear the direct cost of returning the goods.
HOW TO RETURN OR EXCHANGE
– You have the right to return / exchange any / all Kišna glista products you have purchased directly from our website within 7 days of receiving the item.
– All goods will be inspected on return.
– The product(s) must be unused – in its original packaging with labels and protective stickers intact – and still in the same new condition as when the product was received.
– If the item is out of stock in the size or color you have opted for, then a refund will be issued instead.
– If you want a different item, or the item you want is a different price to the price at which you bought the original product, then you’ll need to return the unwanted item for a refund and place a new order.
– The goods are your responsibility until they reach our warehouse, so make sure it’s packed up properly and can’t get damaged on the way!
– Kišna glista does not take responsibility for any items lost during the return shipping.
– Depending on the options available in your country, you’ll be responsible for all the cost of returning any items.
– Make sure you use a postal service that insures you for the value of the items you are returning and obtain proof of posting.
– We are not responsible for any items that are returned to us by mistake.
– In the unlikely event that an item is returned to us in an unsuitable condition, we may have to send it back to you.
– Partial Refund: in the case that a refund is requested, the cost of shipping and any import fees are the responsibility of the Client. The cost of return shipping is EUR 35, plus the cost of import fees. This amount will be deducted from the final refund.
– All refunds will be issued in the same currency as the original purchase.
– Any differences in the amount refunded are due to exchange rate fluctuations and will not be reimbursed.
– Shipping fees and import fees of the order are non-refundable.
Complaints and Claims Procedure

Your complaint should include:

We will confirm the receipt of your complaint within 8 days and provide you with a written response indicating whether the complaint is accepted, and the method and time frame for resolving it.
If the complaint is accepted, the resolution may involve:

repair or replacement of the goods,

a price reduction, or
-
a full refund.
The deadline for resolving complaints will not exceed 15 days from the day of filing the complaint.
DAMAGED OR INCORRECT ITEMS
Damage or incorrect products must be reported within 24 hour after delivery. If your product is damaged in transport you must report this as soon as possible by sending us detailed descriptions and images.
Very important is that in all types of returns the product is packaged in such a way that it cannot be damaged during transit. In the case that a returned product has no errors or faults, a fee of 35 EUR in shipping return will be charged. Kišna glista has the right to replace defective products with products of the same or similar model.
REPEATED RETURNS
We offer a flexible returns policy to make your online shopping experience even easier. Please be aware that we can exchange the same item for a different size only once. We do monitor the number of returns made by customers, and continued returns will be flagged and potentially refused at our discretion or lead to the closure of your Kišna glista account.
ORDER CANCELATION
Please notice that you can cancel your order within 24 hours since you purchase. We realize that this is a bit uncommon but we have very limited production and very high demand. So after that 24 hours passes, we will finish your order and proceed to sending them to your address.
